Testimonial from a Canadian Musician

Late Dec., 2010 I was traveling from Vancouver Island, Canada going east in British Columbia, to a New Years Eve engagement in the town of Osoyoos which is located slightly north of the US Oroville border. I was the last of a convoy of five vehicles entering the city. It was dark and being tired from driving all day, I made a wrong turn and accidentally drove through the 49th. parallel and unknowingly entered the US border. Unable to turn my vehicle around, I was immediately ordered by Homeland Security officers to advance though the border crossing and I was directed to a full personal and vehicle inspection.

I was detained for four hours and Inspection discovered a minimal amount of marijuana (2.8 grams.) and some cigarette rolling papers in the glove compartment of my equipment van. After the full inspection of my van which contained all of the musical equipment for my band members, nothing else was discovered and I was charged with two counts, mainly, (1) personal possession of marijuana under 40 grams and (2) marijuana paraphernalia. I was issued a ticket by the County sheriff to appear in Okanogan County court one week later and could face a possible sentence from 1 to 90 days in jail and $200.00 to $1,000.00 fine.

I was then released to return back through the Canadian border to continue with my musical engagement along with an order that failure to appear in the Okanogan court on the set date to appear would initiate an international warrant out for my arrest. Upon arriving back home which was several hundreds of miles back, I searched the internet for several US attorneys and eventually found the US law firm of Steve Graham. With swift and decisive legal action on his part in handling this matter, I was able to continue with my upcoming musical engagements in Canada and avoid several trips to the US to face what could have been a possibility of up to two jury trials. Steve resolved my order to appear in court and as a result, no jail time, no jury trial and no criminal record.

As a 67-year-old Canadian, I have never had a criminal record in any country in my entire life, and Steve Graham has helped me tremendously in taking the stress out of the charge, resolve the situation quickly without a huge inconvenience in my personal and musical business life. Steve has also been wonderful in keeping me fully informed every step of the legal process in what could have eventually turned out to be an extremely painful and expensive situation. Thank you from a Canadian senior musician to a very professional US attorney!

Please visit Steve Graham's most recent blog article on the accuracy of the breath test in DUI cases. It is often assumed that the BAC test in DUI / DWI cases is accurate. That is not correct. A breath test is affected by a number of different factors, and an unreliable breath test should be disregarded by the court and by DOL.
